Welcome to Everdream. Please read these Terms and Conditions carefully before using our application.

1. Acceptance of Terms

By accessing and using Everdream ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

2. Description of Service

Everdream is an AI-powered image generation application that allows users to create images by providing text prompts. The App processes your prompts through third-party AI services and delivers generated images that are stored locally on your device.

3. Use of Third-Party AI Services

The App uses external AI service providers to generate images. By using the App, your text prompts will be transmitted to these third-party services for processing. The App currently uses the following AI providers:

4. Data Storage and Privacy

All generated images are stored locally on your device only. While prompts are transmitted to third-party AI services for processing, we do not store your prompts or images on our servers. Please review our Privacy Policy for more information.

5. Acceptable Use Policy

You agree not to use the App to generate or attempt to generate:

Illegal content or content that violates any applicable laws or regulations
Content involving minors in any inappropriate, sexual, or harmful context
Child sexual abuse material (CSAM) or any related content
Hate speech, harassment, threats, or discriminatory content
Content that promotes violence, self-harm, or harm to others
Content that infringes on others' intellectual property rights, trademarks, or copyrights
Misleading deepfakes or manipulated images of real, identifiable people without their consent
Content intended to deceive, defraud, or manipulate others
Spam, malware, or malicious content
Content that attempts to bypass, disable, or circumvent safety filters or content policies
Any other content prohibited by our AI service providers' policies

Violation of this Acceptable Use Policy may result in immediate termination of your access to the App.

6. Content Ownership and Rights

You retain ownership of the images generated through the App, subject to the terms of the AI providers used to generate them. However, you are solely responsible for ensuring your use of generated content complies with applicable laws, third-party rights, and intellectual property regulations.

Generated images may not be used for any purpose that violates these Terms or the policies of our AI service providers.

7. Intellectual Property

The App, including its design, features, and functionality, is owned by Everdream and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

8. Disclaimers and Warranties

THE APP AND ALL AI-GENERATED CONTENT ARE PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not guarantee:

The accuracy, quality, appropriateness, or fitness for any purpose of generated images
That generated content will be free from errors, biases, or unexpected results
Uninterrupted or error-free operation of the App
That the App will meet your specific requirements or expectations

AI-generated content may contain inaccuracies, biases, inappropriate elements, or artifacts. You use generated content at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVERDREAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

Your use or inability to use the App
Any generated content or outputs from the App
Actions taken based on AI-generated content
Unauthorized access to or use of our servers or any personal information stored therein
Interruption or cessation of the App
Any bugs, viruses, or other harmful code transmitted through the App
Errors or omissions in any content or for any loss or damage incurred as a result of the use of any content
Actions or policies of third-party AI service providers

10. Service Availability and Modifications

The App depends on third-party AI services for image generation. We do not guarantee uninterrupted service and are not responsible for:

Outages, delays, or performance issues with third-party AI providers
Changes to pricing, availability, or features of AI services
Limitations, rate limits, or restrictions imposed by AI providers

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice.

11. User Responsibilities

You are responsible for:

Maintaining the security of your device and any generated content
All activities that occur through your use of the App
Ensuring your use complies with all applicable laws and regulations
Any consequences arising from your use of generated content
Verifying the accuracy and appropriateness of generated content before use

12. Prohibited Actions

You may not:

Attempt to reverse engineer, decompile, or disassemble the App
Use the App for any unlawful purpose or in violation of these Terms
Interfere with or disrupt the App or servers connected to the App
Attempt to gain unauthorized access to any portion of the App
Use automated systems or software to extract data from the App
Resell, redistribute, or commercialize access to the App without authorization

13. Termination

We reserve the right to terminate or restrict your access to the App at any time, without notice, for any reason, including but not limited to violations of these Terms or our Acceptable Use Policy.

Upon termination, all rights granted to you under these Terms will immediately cease.

14. Changes to Terms

We may update these Terms and Conditions at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Everdream regarding your use of the App.
